Privacy Policy – Customers
Purpose and Scope:
Your privacy is important to us and Koolhaus Games Inc. (hereinafter referred to as “Koolhaus”, “we”, “us” and “our”) takes our responsibility of caring for it seriously. This policy describes what information Koolhaus collects when you use the mobile, online and downloadable products and services (“products”) offered by Koolhaus. Koolhaus respects and upholds an individual’s right to privacy and to protection of his or her personal information. Koolhaus is committed to ensuring compliance with applicable privacy legislation.
This policy describes our practices with respect to the collection, use, storage and disclosure of personal information which we collect from individuals who are customers of Koolhaus. It does not apply to information collected, used, or disclosed with respect to corporate or commercial entities.
Definitions
“Personal information” for the purposes of this policy means information about an identifiable individual, including, for example, an individual’s name, home address, telephone number, social security or insurance number, sex, income and family status. It does not include aggregate information which cannot be associated with a specific individual and it does not include information that would enable an individual to be contacted at a place of business, for example an employee’s name, title, business address, or business telephone number.
“Customer” for the purposes of this policy is any individual who uses or applies to use Koolhaus’ products, services, or facilities, including the website.
“Third party” for the purposes of this policy is an individual or an organization other than Koolhaus and the customer.
The information we collect depends on what products you use and how you use them.
Our Responsibilities:
Section 1: Accountability
Koolhaus is accountable for the personal information under its control.
Section 2: Purposes for Collection, Use, and Disclosure
Koolhaus collects and uses personal information that is voluntarily provided by you. This information is collected and used for the following purposes:
- To develop and enhance our products and services.
For example, we may collect and use your game play data to enhance the design of future updates.
- To process payment for the use of our products and services.
For example, we collect and use financial information to process payment for in app purchases.
- To comply with legal and regulatory requirements.
For example, we may collect and use personal information in response to a court order or to fulfil government reporting requirements.
- In order to improve the products and services we provide.
For example, we administer customer satisfaction surveys. Koolhaus is dedicated to providing superior customer service and we may use information voluntarily provided on customer satisfaction surveys in order to improve our products and services.
- In order to understand and respond to questions.
For example, where inquiries are e-mailed to us through the “contact us” or “support” page or email on our web site or elsewhere, we collect and use information you provide to us for the purpose of understanding your inquiry and responding to it.
- To enhance your gameplay or online experience.
For example, we may use per-session cookies, which are data files sent to your browser and stored on your hard-drive when you visit our website. These per-session cookies track your usage on our website and can be deleted by clearing your browser history. We also use log files, which record the IP address of your computer, to track the number of hits to our website.
Section 2.B. How We Collect Information.
Cookies and Similar Technologies:
Cookies are small text files stored on your Internet browser. We use cookies and similar technologies to help us understand things like what web pages, features or ads you view and what games you play. This information helps us keep track of your shopping cart, measure the effectiveness of our advertising, make sure you don’t see the same ad repeatedly and otherwise help enhance your user experience. You can disable cookies, limit the types of cookies you allow, or set your browser to alert you when cookies are being sent.
We use other technologies for similar purposes as a cookie. We use pixels or clear GIFs to collect information about your use of our products and your response to our marketing emails. We use Internet log files (which contain technical data such as your IP address) to monitor traffic on our products, troubleshoot technical problems, detect and prevent fraud and enforce our Terms of Service. Other examples include HTML 5 cookies, Silverlight Application Storage, device fingerprints and “flash cookies.” If you want to remove flash cookies or prevent them from being placed, adjust your preferences in the Macromedia Website Privacy Settings Panel at http://www.macromedia.com/support/documentation/en/flashplayer/help/settings_manager06.html. We currently do not respond to Do Not Track (DNT) signals. We may adopt a DNT standard if one is established. In the meantime, you may opt out of certain types of tracking, including certain analytics and tailored advertising by changing your cookie settings.
We also use Analytics, Advertising, Anti-Cheat and Anti-Fraud technologies in our products that utilize the same cookies and similar mechanisms. These technologies are described below.
Analytics Technologies:
We use our own game servers and internal and third party analytic technologies to collect information about how you use our products, your computer or device and the health of our products.
For instance, Koolhaus may collect and store data from your computer or device when you use our products. This information includes technical and related information about your computer or device and operating system (such as IP Address and device ID), information about your feature usage, gameplay and usage statistics, system interactions and peripheral hardware for purposes described in another section below. If you play a game offline, this data will be stored on your device and transmitted to Koolhaus when your device connects to the Internet. If you participate in online services, Koolhaus also may collect, use, store, transmit and publicly display statistical data regarding game play (including scores, rankings and accomplishments), or identify content that is created and shared by you with other players.
Third party analytics services integrated into our products may combine the information they collect in connection with Koolhaus’ services with information they have independently collected over time and across different websites. Many of these companies collect and use information under their own privacy policies.
Ad Serving Technologies
Some of our products employ ad serving technologies that use cookies, clear GIFs, web beacons, tracking pixels, and other similar technologies like identifiers to deliver offers to you. Some of these technologies can sync or connect behavior across different websites, mobile apps and devices. The ads can be tailored to your interests. For instance, you may be presented with an offer for a game we think you might enjoy. Or if you express interest in a game, you might receive an advertisement later for that game or similar products on Koolhaus or third party sites. Other in-game advertising technologies enable advertising to be temporarily uploaded to your game, web browser, or mobile device and later replaced while you are online.
These technologies collect and use information so we can serve appropriate advertising to you and help track results and measure effectiveness. In addition to identifiers, this information includes: Advertisements served and the location of the ad; Length of time an advertisement was visible; Domain type, IP address, size of the advertisement; and Advertisement response.
Third party advertising companies may combine the information collected in the context of delivering an ad to you via our Products and Services with other information they have independently collected over time and across different websites. Many of these companies collect and use information under their own privacy policies. For more information about the practices of other large ad serving companies that may collect information based on your interaction with ads that Koolhaus may incorporate in our products or others, or to “opt out” of targeted advertising delivered by National Advertising Initiative (NAI) member ad networks, you should visit www.networkadvertising.org.

Note that opting out does not mean you won’t see ads; it just means that the advertising you see may be less relevant to your interests.
D. Anti-Cheat and Fraud Prevention Technologies
Koolhaus strives to provide a safe and fair gaming environment for all players. When you log in to one of our products, set up an Koolhaus Account or make purchases, we or third parties may use cookies and similar technologies, or collect data about your machine or device, to create a machine “fingerprint” or “hash” of your machine components, for fraud prevention, security and authentication purposes. We also may use other anti-cheat technology with our products.
The only circumstances under which personal information may be disclosed to third parties is for the fulfillment of any purposes identified above, as required by law, or with customer consent. Where personal information is disclosed to a third party for the fulfillment of any purposes identified above, Koolhaus will make all reasonable efforts to ensure that the third party has appropriate security procedures in place for the protection of the personal information transferred to it.
Section 3: A. Information You Give Us Directly
We collect information you provide us, including:
- Your email address, username, country, date of birth, telephone number and password;
- Security questions and answers;
- Demographic details, for instance in response to surveys about our products;
- Information you provide when seeking help from us such as your name and records of the issues you experience;
- Billing information, such as your name, address, telephone number and payment card details;
- Your Koolhaus Account information; and
- Information you provide to enter a contest or sweepstakes. If you win, we may need to collect your social insurance or security number, postal address and/or national identification for eligibility, prizes delivery and tax purposes.
Section 3: B. Other Information We Collect When You Use Our Products
We collect other information automatically when you use our products, including:
- IP address;
- Mobile and other hardware or device identifiers;
- Browser information, including your browser type and the language you prefer;
- Referring and exit pages, including landing pages and pages viewed;
- Platform type;
- Information about your media, device, hardware and software, such as your hardware settings and
- components, Koolhaus software and updates you have installed or use, and presence of required plug ins;
- Details about what Koolhaus products you use and your use of them; and
- Device event information, including crash reports, request and referral URL’s and system activity details (i.e. whether you encountered an error playing our games or lost Internet access).
We also may collect and store information locally on your device, using mechanisms like cookies, browser web storage (including HTML 5) and application data caches.
Section 4: Third Party Information Provided To Us
Mobile Platforms. If you play or purchase our games on your mobile device and/or tablet, we receive information about you from the app stores and other mobile platform providers. This information includes your username and/or device ID and the fact that you made a purchase, for instance, but does not include any sensitive or financial information. Some of our mobile platforms also may send information to us that you authorize them to provide. Our mobile products also may request additional personal information from you, such as push notification tokens, your precise location or contact list, and we will collect this information only if you give us your explicit consent.
Other Third Parties
We may receive information from third parties when you use these services in connection with our products. We may also receive information about you when other players choose to share their contact lists with us.
We also may receive information from third parties to supplement the information we receive from you. We use information from these companies primarily to help us deliver relevant advertising to you. We also may use similar services, for instance, to help us understand your approximate geolocation via your IP address for tax purposes, or to customize certain services to your location.
Consent
When you provide us with your personal information, you consent to the use of your personal information as identified in this policy, and as may be further identified at the time of collection. Sometimes you will be asked to give your express consent, such as by checking a box to indicate your consent to receive communications from us. Other times, we may obtain your consent implicitly when we can reasonably conclude that you have given consent by some action you have taken or an action you have decided not to take. Generally, this occurs where the purpose for use of your personal information would be reasonably apparent to you.
Unless we hear otherwise from you, your use of Koolhaus’ products and services constitute implicit consent for Koolhaus to collect, use, and disclose personal information for the purposes stated in this policy.
You may refuse or withdraw consent at any time, subject to legal and contractual restrictions and reasonable notice. Refusal or withdrawal of consent may prevent Koolhaus from providing to you a product or service regardless of whether you have paid for that product or service in advance. Koolhaus will not reimburse you for any expenditures made up to and including the time and date of your refusal or withdrawal of consent.
You may refuse or withdraw your consent by contacting us at support@koolhausgames.com. Our staff will explain your options and any consequences of refusing or withdrawing consent, and will record your choices.
Section 5: Limiting Collection
We collect personal information only for the purposes identified above.
Section 6: Limiting Use, Disclosure, and Retention
We do not use or disclose personal information for any purpose other than those for which it was collected, except as required by law, or with consent.
Personal information is retained only as long as is necessary for the fulfillment of the purposes for which it was collected, or as required by law.
Section 7: Accuracy
Koolhaus will make all reasonable efforts to ensure that personal information is as accurate, complete, and current as required for the purposes for which it was collected. In some cases, Koolhaus relies on individuals to ensure that certain information about them, such as their contact information, is current, complete, and accurate.
Section 8: Storage and Safeguards
Koolhaus will make all reasonable efforts to ensure that personal information is protected against such risks as loss, theft, unauthorized access, disclosure, copying, use, modification, or destruction. Safeguards include physical, administrative, and electronic security measures.
Koolhaus may process and store your information in Canada or the United States of America, and therefore Canadian and United States governments, courts, or law enforcement or regulatory agencies (or, by treaty, foreign countries) may be able to obtain disclosure of your information through Canadian or United States of America laws. By consenting to the information practices set out in this policy, you specifically consent to your information being processed and stored in Canada or the United States of America.
We may use third party service providers (for example, web hosting providers, advertising aggregators and/or payment processers) to manage one or more aspects of our business operations, including the processing or handling of personal information. When we do use an outside company, we use contractual or other appropriate means to ensure that your personal information is used in a manner that is consistent with this policy. Some of these operations may result in personal information collected by us being stored or processed in Canada and the United States of America and, as a result, your personal information may be accessible to law enforcement and regulatory authorities in accordance with the USA PATRIOT Act and other applicable laws of the United States of America, as well as Canadian laws.

Section 10: Revisions To This Privacy Policy
The development of Koolhaus’ policies and procedures for the protection of personal information is an ongoing process. Due to changes in technology and legal requirements we may revise this policy from time to time. Please ensure that you refer to the current version of Koolhaus’ Privacy Policy. The current version will be posted on our site of the applicable app store or made available to you by writing to us at Privacy Officer, P.O. Box 5087 VMPO, Vancouver, B.C. V6B 2P6
Section 11: Questions or Concerns Regarding Koolhaus’ Compliance
Individuals may direct their general questions regarding privacy practices at Koolhaus, as well as any questions or concerns regarding Koolhaus’ compliance with this policy, to the Privacy Officer, P.O. Box 5087 VMPO, Vancouver, B.C. V6B 2P6.
The Privacy Officer will investigate any complaints received in writing. If a complaint is found to be justified, the Privacy Officer will take appropriate measures to resolve the complaint including, if necessary, amending its policies and procedures. A customer will be informed, in writing, of the outcome of the investigation regarding his or her complaint.
